The Buyer's Agent Agreement Nobody Explained to You

You searched for a buyer's agent because a Hamel or West Metro listing agent just handed you a buyer's agent agreement and asked you to sign it before showing you a house, and no one walked you through what it means. Here is the straight version. Since the National Association of Realtors settlement took effect in August 2024, a written buyer representation agreement is required before an agent tours homes with you, and it spells out what the agent does for you and how the agent gets paid. What Is a Buyer's Agent?

A buyer's agent is a licensed real estate agent for buying a home who represents you, the buyer, and owes you a fiduciary duty. That duty matters. It means the agent negotiates for your price and your terms, tells you when a house is overpriced, and keeps what you share confidential from the seller. The listing agent on the other side works for the seller and is legally on the seller's side. A buyer's agent is your counterweight to that.

What Is a Buyer's Agent Agreement?

A buyer's agent agreement is the written contract that hires an agent to represent you, and since August 2024 you sign one before an agent tours homes with you. It states the length of the arrangement, the geographic and property scope, the services the agent provides, and the compensation. It does not obligate you to buy a house. It defines the working relationship while you search, and its terms are negotiable, including the length and the pay.

What the agreement typically spells out

  • Term length. How long the agreement lasts. This is negotiable. Some buyers start with a short term or a single-showing agreement while they decide if the fit is right.
  • Scope. The area and property types the agreement covers, for example resale homes in the West Metro.
  • Services. What the agent does: touring, comparative market analysis, offer strategy, negotiation, inspection support, and closing coordination.
  • Compensation. How the agent is paid, the amount or rate, and how it is handled if the seller's side contributes toward it.
  • Termination. How either side can end the agreement if the relationship is not working.

Who Pays the Buyer's Agent in a West Metro Deal?

Buyer's agent compensation is negotiable and stated in your agreement, and depending on the transaction it can be paid by the seller or listing side, by you, or split. After the NAR settlement, sellers are no longer required to advertise a set buyer-agent commission through the MLS, so who pays is now negotiated deal by deal rather than assumed. That is the real change, and it is why the agreement puts the number in writing up front.

How it usually plays out here: in many West Metro purchases the seller's side still contributes toward the buyer's agent compensation, and we ask for that concession as part of the offer. When they do not, we have already told you the number in your agreement, so there is no surprise at the closing table. Either way, you know the figure before you write an offer, not after.

We frame our compensation qualitatively and openly during your consultation rather than hiding it in fine print. What we will not do is quote you a number on a web page that ignores your specific purchase. The right figure depends on the price band, the property, and how the seller's side is willing to negotiate, and we walk through all of it before you commit.

When you may not need to sign with us: if you are buying directly from a family member at an agreed price with a real estate attorney already handling the paperwork, a buyer's agent adds little, and we would rather tell you that than lock you into an agreement where we are not earning it. Do not feel pressured to sign a long-term agreement to see one house either. Ask for a short term or a single-showing agreement first.
